1 Any person who, in the exercise of express statutory powers, orders or carries out the surveillance of the post or telecommunications of another or makes use of technical surveillance devices (Art. 179bis ff.) does not commit an offence provided that the approval of the appropriate court is obtained without delay.
2 The requirements for the surveillance of post or telecommunications and the procedure therefor is governed by the Federal Act of 6 October 2000218 on the Surveillance of Post and Telecommunications.

1 Wer in Ausübung ausdrücklicher, gesetzlicher Befugnis die Überwachung des Post- und Fernmeldeverkehrs einer Person anordnet oder durchführt oder technische Überwachungsgeräte (Art. 179bis ff.) einsetzt, ist nicht strafbar, wenn unverzüglich die Genehmigung des zuständigen Richters eingeholt wird.
2 Die Voraussetzungen der Überwachung des Post- und Fernmeldeverkehrs und das Verfahren richten sich nach dem Bundesgesetz vom 6. Oktober 2000218 betreffend die Überwachung des Post- und Fernmeldeverkehrs.
