1 For the determination of the law applicable to the formation, declaration or contesting of a parent-child relationship, the date of birth is decisive.
2 However, in case of a judicial declaration or contesting of a parent-child relationship, the date of the action is decisive if a preponderant interest of the child so requires.
1 Für die Bestimmung des auf die Entstehung, Feststellung oder Anfechtung des Kindesverhältnisses anwendbaren Rechts ist der Zeitpunkt der Geburt massgebend.
2 Bei gerichtlicher Feststellung oder Anfechtung des Kindesverhältnisses ist jedoch der Zeitpunkt der Klageerhebung massgebend, wenn ein überwiegendes Interesse des Kindes es erfordert.
