1 The provisions of this Part apply to the proceedings before arbitral tribunals based in Switzerland, unless the provisions of the Twelfth Chapter of the PILA173 apply.
2 The parties may exclude the application of this Part by making a declaration to this effect in the arbitration agreement or a subsequent agreement, and instead agree that the provisions of the Twelfth Chapter of the PILA apply. The declaration must be in the form specified in Article 358.174

Die gerichtliche Beurteilung der geschuldeten Leistung bleibt in jedem Fall vorbehalten. Insbesondere kann die verpflichtete Partei jederzeit auf Feststellung klagen, dass der Anspruch nicht oder nicht mehr besteht oder gestundet ist.
