1 The court shall instruct the expert and shall submit the relevant questions to him, either in writing or orally at the hearing.
2 The court shall give the parties the opportunity to respond to the questions to be put to the expert and to propose that they be modified or supplemented.
3 The court shall provide the expert with the necessary files and set a deadline for submitting the opinion.
1 Die sachverständige Person ist zur Wahrheit verpflichtet und hat ihr Gutachten fristgerecht abzuliefern.
2 Das Gericht weist sie auf die Strafbarkeit eines falschen Gutachtens nach Artikel 307 StGB68 und der Verletzung des Amtsgeheimnisses nach Artikel 320 StGB sowie auf die Folgen von Säumnis und mangelhafter Auftragserfüllung hin.
3 Die sachverständige Person hat Anspruch auf Entschädigung. Der gerichtliche Entscheid über die Entschädigung ist mit Beschwerde anfechtbar.
