Art. 8a

1 If the invention concerns a manufacturing process, the effects of the patent also extend to the products directly obtained by that process.

2 If the products directly obtained by the process concern biological material, the effects of the patent also extend to products obtained by propagating the biological material and which demonstrate the same characteristics. Article 9a paragraph 3 remains reserved.29

Art. 8a

1 Betrifft die Erfindung ein Herstellungsverfahren, so erstreckt sich die Wirkung des Patents auch auf die unmittelbaren Erzeugnisse des Verfahrens.

2 Handelt es sich bei den unmittelbaren Erzeugnissen um biologisches Material, so erstreckt sich die Wirkung des Patents zudem auf Erzeugnisse, die durch Vermehrung dieses biologischen Materials gewonnen werden und dieselben Eigenschaften aufweisen. Artikel 9a Absatz 3 bleibt vorbehalten.29
