Any person who brings an action under Articles 72, 73, 74 or 81 and subsequently brings a further action against the same party for the same or a similar act on the basis of another patent must bear the court costs and the other party's costs for the new procedure if he does not provide prima facie evidence that in the prior action he was, through no fault on his part, unable to invoke the other patent.
Wer eine der in den Artikeln 72, 73, 74 oder 81 vorgesehenen Klagen erhoben hat und später wegen der gleichen oder einer gleichartigen Handlung auf Grund eines andern Patentes eine weitere Klage gegen die gleiche Person erhebt, hat die Gerichts- und Parteikosten des neuen Prozesses zu tragen, wenn er nicht glaubhaft macht, dass er im früheren Verfahren ohne sein Verschulden nicht in der Lage war, auch dieses andere Patent geltend zu machen.
