232.11 Bundesgesetz vom 28. August 1992 über den Schutz von Marken und Herkunftsangaben (Markenschutzgesetz, MSchG)
Art. 27b Entitlement to apply for registration
The registration of a geographical mark may be requested by:
- a.
- the group that has obtained the registration of the appellation of origin or the geographical indication, or where such group no longer exists, the representative group dealing with the protection of this appellation of origin or geographical indication;
- b.
- the Swiss canton that protects the appellation d’origine contrôlée or the foreign authority responsible for the regulation of wine denominations corresponding to Article 63 AgricA23, as well as the group that obtained the protection of such a foreign wine denomination;
- c.
- the umbrella organisation of an economic sector for which the Federal Council has enacted an ordinance based on Article 50 paragraph 2 or which acts on the basis of on an equivalent foreign regulation.
Art. 27b Eintragungsberechtigte
Die Eintragung einer geografischen Marke kann verlangt werden:
- a.
- von einer Gruppierung, die die Ursprungsbezeichnung oder die geografische Angabe hat eintragen lassen, oder, wenn diese Gruppierung nicht mehr besteht, von der repräsentativen Gruppierung, die sich für den Schutz dieser Ursprungsbezeichnung oder geografischen Angabe einsetzt;
- b.
- vom Schweizer Kanton, der die kontrollierte Ursprungsbezeichnung schützt, oder von der ausländischen Behörde, die für die Regelung von Weinbezeichnungen zuständig ist, welche Artikel 63 LwG23 entsprechen, sowie von der Gruppierung, die eine solche ausländische Weinbezeichnung hat schützen lassen;
- c.
- von der Dachorganisation einer Branche, für die der Bundesrat gestützt auf Artikel 50 Absatz 2 eine Verordnung erlassen hat oder die sich auf eine gleichwertige ausländische Regelung stützt.
