Art. 4 Secretariat

1 In agreement with the chair of the Arbitration Commission, the Department shall appoint the secretariat of the Arbitration Commission, which shall be headed by a legal secretary. The Department shall provide the necessary infrastructure.7

1bis The employment relationship of the secretariat personnel is governed by federal legislation on the personnel of the Confederation.8

2 The secretariat is independent from the administrative authorities in carrying out its functions and is only bound to the instructions of the chair.

3 The legal secretary shall carry out the following tasks, in particular:

a.
drafting decisions, consultations and communications addressed to parties and authorities;
b.
taking minutes;
c.
maintaining documentation, providing the public with information about the Arbitration Commission and editing decisions intended for publication.

4 The legal secretary acts in an advisory capacity in procedures in which he or she is taking minutes.

Art. 4 Sekretariat

1 Das Departement bestellt im Einvernehmen mit dem Präsidenten oder der Präsidentin der Schiedskommission das Sekretariat der Schiedskommission, dem ein juristischer Sekretär oder eine juristische Sekretärin vorsteht. Es stellt die erforderliche Infrastruktur zur Verfügung.7

1bis Das Arbeitsverhältnis des Sekretariatspersonals richtet sich nach der Personalgesetzgebung des Bundes.8

2 Das Sekretariat ist in der Ausübung seiner Funktionen von den Verwaltungsbehörden unabhängig und nur an die Weisungen des Präsidenten oder der Präsidentin gebunden.

3 Der juristische Sekretär oder die juristische Sekretärin erfüllt insbesondere folgende Aufgaben:

a.
Redaktion von Verfügungen, Vernehmlassungen und Mitteilungen an Parteien und Behörden;
b.
Protokollführung;
c.
Führung der Dokumentation, Information der Schiedskommission und redaktionelle Bearbeitung der für die Veröffentlichung geeigneten Entscheide.

4 Der juristische Sekretär oder die juristische Sekretärin hat in Verhandlungen, in denen er oder sie das Protokoll führt, beratende Stimme.
