1 The provisions governing the personal liability or liability to make additional contributions of the members and the reduction or cancellation of share certificates may be amended only by amending the articles of association.
2 Furthermore, the provisions governing reductions of capital by companies limited by shares apply to any reduction or cancellation of share certificates.719
3 Any reduction of a member’s personal liability or liability to make additional contributions shall have no effect on obligations that arose prior to publication of the amendment to the articles of association.
4 Where a member’s personal liability or liability to make additional contributions is established or increased, on entry of the resolution in the commercial register it works in favour of all creditors of the cooperative.

1 Die Statuten können die Genossenschafter an Stelle oder neben der Haftung zur Leistung von Nachschüssen verpflichten, die jedoch nur zur Deckung von Bilanzverlusten dienen dürfen.
2 Die Nachschusspflicht kann unbeschränkt sein, sie kann aber auch auf bestimmte Beträge oder im Verhältnis zu den Mitgliederbeiträgen oder den Genossenschaftsanteilen beschränkt werden.
3 Enthalten die Statuten keine Bestimmungen über die Verteilung der Nachschüsse auf die einzelnen Genossenschafter, so richtet sich diese nach dem Betrag der Genossenschaftsanteile oder, wenn solche nicht bestehen, nach Köpfen.
4 Die Nachschüsse können jederzeit eingefordert werden. Im Konkurse der Genossenschaft steht die Einforderung der Nachschüsse der Konkursverwaltung zu.
5 Im Übrigen sind die Vorschriften über die Einforderung der Leistungen und über die Verlustigerklärung anwendbar.
