152.3 Bundesgesetz vom 17. Dezember 2004 über das Öffentlichkeitsprinzip der Verwaltung (Öffentlichkeitsgesetz, BGÖ)
Art. 18 Duties and Competencies
The Federal Data Protection and Information Commissioner (the Commissioner) pursuant to Article 26 of the Data Protection Act10 shall, in particular, have the following duties and competencies under the present Act:
- a.
- conducting mediation proceedings (Art. 13) and making a recommendation (Art. 14), should mediation not succeed;
- b.
- providing information ex officio, or at the request of individuals or authorities, on the modalities governing access to official documents;
- c.
- commenting on draft legislation and measures of the Federal Government which have a fundamental impact on the principle of freedom of information.
Art. 18 Aufgaben und Kompetenzen
Die oder der Eidgenössische Datenschutz- und Öffentlichkeitsbeauftragte (die oder der Beauftragte) nach Artikel 26 des Datenschutzgesetzes10 hat nach dem vorliegenden Gesetz insbesondere folgende Aufgaben und Kompetenzen:
- a.
- Sie oder er leitet das Schlichtungsverfahren (Art. 13) und gibt, für den Fall, dass es zu keiner Schlichtung kommt, eine Empfehlung ab (Art. 14).
- b.
- Sie oder er informiert von Amtes wegen oder auf Anfrage Private und Behörden über die Modalitäten des Zugangs zu amtlichen Dokumenten.
- c.
- Sie oder er kann sich zu Erlassentwürfen und Massnahmen des Bundes, welche das Öffentlichkeitsprinzip wesentlich betreffen, äussern.
