1 The competent authority shall enter in the Schengen Information System (SIS) the data on third-country citizens subject to any of the following return decisions:
2 Data on third-country citizens against whom bans on entry in accordance with Articles 67 and 68 paragraph 3 and an order for expulsion from Switzerland have been issued shall entered by the competent authority in the SIS provided the requirements of Regulation (EU) 2018/1861156 have been met.
3 SEM may supply biometric data to the SIS that is already available in the automated fingerprint identification system under Article 354 SCC (AFIS) or in ZEMIS. The supply of data may be automated.
4 The competent authorities for issuing an alert on decisions in accordance with paragraphs 1 and 2 shall record in ZEMIS the personal data of the person to whom the alert relates. If the facial image and the fingerprints are not already available, they shall record these data in AFIS for delivery to the SIS or have the data recorded there by the authorities entitled to do so.
5 In connection with its alerts, fedpol may supply biometric data to the SIS that is already available in the AFIS. The supply of data may be automated. If no biometric data are available, fedpol may order the retroactive recording of the data from the authorities that detect a hit on these alerts.
6 The Federal Council shall regulate the procedure and responsibilities for recording and transmitting the data in accordance with paragraphs 1–5 for the purpose of alerts in the SIS. It may provide for exceptions to the requirement to record and deliver data with regard to biometric data.

1 Die zuständige Behörde trägt in das Schengener Informationssystem (SIS) die Daten von Drittstaatsangehörigen, gegen die eine der folgenden Rückkehrentscheide verfügt wurde, ein:
2 Daten von Drittstaatsangehörigen, gegen die Einreiseverbote nach den Artikeln 67 und 68 Absatz 3 sowie eine Landesverweisung erlassen wurden, werden durch die zuständige Behörde in das SIS eingetragen, sofern die Voraussetzungen der Verordnung (EU) 2018/1861156 erfüllt sind.
3 Das SEM kann biometrische Daten, die schon im automatisierten Fingerabdruck-Identifikationssystem nach Artikel 354 StGB (AFIS) oder im ZEMIS verfügbar sind, an das SIS liefern. Die Lieferung kann automatisiert erfolgen.
4 Die für die Ausschreibung der Entscheide nach den Absätzen 1 und 2 zuständigen Behörden erfassen im ZEMIS die Personendaten der auszuschreibenden Person. Sind das Gesichtsbild und die Fingerabdrücke nicht schon vorhanden, so erfassen sie zwecks Lieferung an das SIS diese Daten in AFIS oder lassen diese dort durch die berechtigten Behörden erfassen.
5 Fedpol kann bei seinen Ausschreibungen die schon im AFIS verfügbaren biometrischen Daten an das SIS liefern. Die Lieferung kann automatisiert erfolgen. Sind keine biometrischen Daten vorhanden, so kann fedpol deren nachträgliche Erhebung bei den Behörden, die einen Treffer auf diese Ausschreibungen feststellen, anordnen.
6 Der Bundesrat regelt das Verfahren und die Zuständigkeiten für die Erfassung und Übermittlung der Daten nach den Absätzen 1–5 zwecks Ausschreibungen im SIS. Er kann Ausnahmen bei der Erfassung und Lieferung hinsichtlich der biometrischen Daten vorsehen.
