Art. 45 Mindestkapital und Sicherheiten

1 Wertpapierhäuser müssen über das verlangte Mindestkapital verfügen. Dieses muss vollständig einbezahlt sein.

2 Die FINMA kann Wertpapierhäusern in Form von Personengesellschaften erlauben, anstelle des Mindestkapitals angemessene Sicherheiten zu leisten.

3 Der Bundesrat regelt die Höhe des Mindestkapitals und der Sicherheiten.

Art. 45 Minimum capital and collateral

1 Securities firms must possess the required minimum capital. This must be fully paid up.

2 FINMA may permit securities firms in the form of partnerships to post appropriate collateral instead of the minimum capital.

3 The Federal Council shall regulate the amount of the minimum capital and of the collateral.
