941.311 Ordinance of 8 May 1934 on the Control of Trade in Precious Metals and Articles of Precious Metals (Precious Metals Control Ordinance, PMCO)
Art. 165b
1 Einzelpersonen fügen ihrem Gesuch bei:
- a.
- eine Wohnsitzbescheinigung, ausgestellt durch die kommunale Behörde;
- b.
- einen Auszug der Eintragung im Schweizerischen Handelsregister;
- c.
- einen Privatauszug aus dem Strafregister-Informationssystem VOSTRA;
- d.161
- Angaben über alle im In- und Ausland hängigen oder abgeschlossenen Zivil, Straf-, Verwaltungs-, Aufsichts-, Betreibungs- oder Konkursverfahren, sofern sich diese Angaben auf den guten Ruf und die Gewähr für eine einwandfreie Geschäftstätigkeit auswirken könnten; und
- e.162
- eine Bestätigung der zuständigen kommunalen oder kantonalen Behörden, aus der hervorgeht, dass die der Edelmetallschmelzung dienenden Einrichtungen und Lokalitäten den Umwelt- und Brandschutzauflagen entsprechen.
2 Handelsgesellschaften und Genossenschaften sowie die schweizerischen Zweigniederlassungen ausländischer Gesellschaften fügen ihrem Gesuch bei:
- a.
- einen Auszug der Eintragung im Schweizerischen Handelsregister;
- b.
- einen Privatauszug aus dem Strafregister-Informationssystem VOSTRA für die leitenden Personen und die Personen, welche die Geschäfte mit dem Schmelzgut und den Schmelzprodukten besorgen;
- c.163
- Angaben über alle im In- und Ausland hängigen oder abgeschlossenen Zivil, Straf-, Verwaltungs-, Aufsichts-, Betreibungs- oder Konkursverfahren gegen die mit der Geschäftsführung betrauten Personen und gegen Personen, welche die Geschäfte mit dem Schmelzgut und den Schmelzprodukten besorgen, sofern sich diese Angaben auf den guten Ruf und die Gewähr für eine einwandfreie Geschäftstätigkeit auswirken könnten; und
- d.164
- eine Bestätigung der zuständigen kommunalen oder kantonalen Behörden, aus der hervorgeht, dass die der Edelmetallschmelzung dienenden Einrichtungen und Lokalitäten den Umwelt- und Brandschutzauflagen entsprechen.
Art. 165b
1 Individuals must enclose the following with their applications:
- a.
- an attestation of place of residence, issued by the communal authorities;
- b.
- an extract from their entry in the Swiss Commercial Register;
- c.
- a standard private extract from the VOSTRA Register of Criminal Records Information System;
- d.161
- information on all pending or completed civil, criminal, administrative, supervisory, debt collection or bankruptcy proceedings in Switzerland and abroad, where such information could impinge on the good reputation and the guarantee of irreproachable business conduct; and
- e.162
- an attestation from the relevant communal or cantonal authorities showing that the facilities and premises being used for precious metal melting comply with environmental and fire-prevention regulations.
2 Commercial enterprises and cooperatives as well as the Swiss branches of foreign companies must enclose the following with their applications:
- a.
- an extract from their entry in the Swiss Commercial Register;
- b.
- a standard private extract from the VOSTRA Register of Criminal Records Information System for the members of management and for those persons in charge of transactions with melt material and melt products; and
- c.163
- information on all pending or completed civil, criminal, administrative, supervisory, debt collection or bankruptcy proceedings in Switzerland and abroad against the members of management and against persons in charge of transactions with melt material and melt products, where such information could impinge on the good reputation and the guarantee of irreproachable business conduct; and
- d.164
- an attestation from the relevant communal or cantonal authorities showing that the facilities and premises being used for precious metal melting comply with environmental and fire-prevention regulations.
