1 Wird die Verantwortlichkeitsmarke beanstandet, so nimmt das Zentralamt eine Untersuchung vor.
2 Ist die Beanstandung begründet und liegt ein Vergehen im Sinne des Artikels 47 des Gesetzes vor, so wird die Ware beschlagnahmt und Strafanzeige erstattet.
3 Ist trotz begründeter Beanstandung der Verantwortlichkeitsmarke ein Vergehen nicht anzunehmen, so verhängt das Zentralamt eine Ordnungsbusse über den Gesuchsteller und fordert diesen auf, für die Anbringung einer ordnungsmässigen Verantwortlichkeitsmarke besorgt zu sein. Zu diesem Zwecke wird die Ware dem Gesuchsteller ungestempelt zurückgegeben.
1 If an objection is raised to the responsibility mark, the Central Office shall conduct an investigation.
2 If the objection is found to be justified and if an offence has been committed in accordance with Article 47 of the Act, the article shall be seized and a criminal complaint filed.
3 If it cannot be assumed that an offence has been committed, despite the objection to the responsibility mark, the Central Office shall impose a fixed penalty on the applicant and order him to affix the correct responsibility mark. The article shall be returned to the applicant unstamped for this purpose.
