1 Für Einfuhren ist eine Kontrollbescheinigung im System zur elektronischen Bescheinigung von Einfuhren biologischer Erzeugnisse der EU (Traces) nach der Delegierten Verordnung (EU) 2021/2306161 auszustellen. Wird die Sendung vor der Veranlagung in mehrere Partien aufgeteilt, so muss für jede Partie, die sich aus der Aufteilung ergibt, eine Teilkontrollbescheinigung in Traces ausgestellt werden.162
2 Die Schweiz nutzt das Informationssystem Traces der EU.
3 Das BLW erteilt den Zertifizierungsstellen und Unternehmen in der Schweiz die Zugangsrechte zu Traces. Es stützt sich dabei auf die Prüfung, die die Zertifizierungsstellen in Bezug auf die Identität der bei ihnen unter Vertrag stehenden Unternehmen vorgenommen haben. Es kann die Zugangsrechte zu Traces weiteren Behörden des Bundes und der Kantone erteilen, wenn dies zur Erfüllung ihrer Aufgaben nötig ist.
4 In Fällen, in denen das Informationssystem Traces nicht funktioniert, können Kontrollbescheinigungen und Teilkontrollbescheinigungen ausgestellt und mit einem Sichtvermerk versehen werden, ohne dass Traces verwendet wird.
5 Das WBF regelt die Kontrollbescheinigungen und die Teilkontrollbescheinigungen in Traces sowie die Verfahren.163
6 Das BLW kann die Kontrollbescheinigungspflicht für Einfuhren aus Ländern nach Artikel 23 oder für solche, die von Stellen nach Artikel 23a Absatz 2 zertifiziert worden sind, erleichtern oder aufheben.164

1 For imports, a certificate of inspection must be issued in the EU system for the electronic certification of the import of organic products (Traces) in accordance with Commission Delegated Regulation (EU) 2021/2306.161 Where a consignment is to be split into several batches before assessment, an extract from the certificate of inspection in Traces must be issued for each batch resulting from the split.162
2 Switzerland uses the EU’s Traces information system.
3 FOAG shall grant certification bodies and operators in Switzerland access rights to Traces. It bases its decision on the check that the certification bodies have carried out in relation to the identity of the operators that they have under contract. It may grant access rights to Traces to other federal and cantonal authorities if this is required to fulfil its duties.
4 In cases in which the Traces information system does not work, certificates of inspection and extracts from certificates of inspection may be issued and endorsed without using Traces.
5 The EAER shall regulate the certificates of inspection and extracts from certificates of inspection in Traces as well as the procedures.163
6 FOAG may facilitate or cancel the obligation to issue the certificate of inspection for imports from countries under Article 23 or for imports that have been certified by bodies under Article 23a paragraph 2.164
