Art. 13a Verwendung von nicht biologischem Saatgut und vegetativem Vermehrungsmaterial

1 Wer nicht biologisches Saatgut oder vegetatives Vermehrungsmaterial verwenden will, muss nachweisen, dass:

a.
kein geeignetes biologisch erzeugtes Saatgut oder vegetatives Vermehrungsmaterial verfügbar ist, welches seine Anforderungen erfüllt; oder
b.
kein Anbieter in der Lage ist, das Saatgut oder vegetative Vermehrungs-material vor der Aussaat oder Anpflanzung zu liefern, obwohl er es vom Verwender rechtzeitig bestellt hatte.

2 Als Nachweis nach Absatz 1 gilt ein Ausdruck des vorhandenen Angebotes vom Informationssystem nach Artikel 33a.

3 Wer nicht-biologisches Saatgut oder vegetatives Vermehrungsmaterial verwendet, muss dem Betreiber des Informationssystems gemäss Artikel 33a die Menge des eingesetzten Saatgutes oder vegetativen Vermehrungsmaterials und die verwendete Sorte melden.

4 Für Arten oder Untergruppen von Arten ohne oder mit nur sehr geringer Versorgung an biologisch erzeugtem Saatgut oder vegetativem Vermehrungsmaterial kann nicht biologisches Saatgut oder vegetatives Vermehrungsmaterial ohne Nachweis nach Absatz 2 und ohne Meldung nach Absatz 3 verwendet werden. Der Betreiber des Informationssystems bezeichnet die entsprechenden Sorten und Arten im Informationssystem nach Weisungen des Bundesamts für Landwirtschaft (BLW).70

5 Für Arten und Untergruppen von Arten nach Artikel 13 Absatz 3bis darf nur dann nicht biologisches Saatgut und vegetatives Vermehrungsmaterial eingesetzt werden, wenn das BLW eine Bewilligung für die Verwendung von nicht biologischem Saatgut und vegetativem Vermehrungsmaterial erteilt. Die Bewilligung wird nur erteilt, falls das Saatgut oder Vermehrungsmaterial zu Forschungszwecken, für Untersuchungen im Rahmen von Feldversuchen kleinen Umfangs oder zur Sortenerhaltung verwendet wird.

6 Nicht biologisches Saatgut und nicht biologische Saatkartoffeln dürfen nur verwendet werden, wenn sie nicht mit Pflanzenschutzmitteln behandelt worden sind; ausgenommen sind die Behandlung mit Pflanzenschutzmitteln, die für die biologische Produktion zulässig sind, und chemische Behandlungen, die aus Gründen der Pflanzengesundheit für alle Sorten einer bestimmten Art im Anbaugebiet vorgeschrieben wurden.71

Art. 13a Use of non-organic seeds and plant propagating material

1 Any person who wishes to use non-organic seeds or plant propagating material must provide evidence that:

a.
no suitable organically produced seeds or plant propagating material are available which fulfil their requirements; or
b.
no supplier is able to deliver the seeds or propagating material before sowing or planting, although they were ordered by the user in good time.

2 A printout of available material taken from the information system described in Article 33a shall be deemed valid evidence under paragraph 1.

3 Any person who uses non-organic seeds or plant propagating material must notify the operator of the information system described in Article 33a of the quantity of seed or plant propagating material used and the variety.

4 In the case of species or sub-species for which there is no supply or only a very small supply of organically produced seeds or plant propagating material, non-organic seeds or plant propagating material may be used without the evidence required under paragraph 2 and without the notification required under paragraph 3. The operator of the information system shall indicate the relevant varieties and species in the information system as instructed by the Federal Office for Agriculture (FOAG).70

5 In the case of species and sub-species referred to in Article 13 paragraph 3bis, non-organic seeds and plant propagating material may only be used if FOAG authorises the use of non-organic seeds and plant propagating material. Authorisation shall only be issued if the seeds or plant propagating material are to be used for research purposes, for tests carried out as part of small-scale field trials or to preserve varieties.

6 Non-organic seeds and non-organic seed potatoes may only be used if they have not been treated with plant protection products; this does not apply to treatment with plant protection products which are authorised for organic farming and chemical treatments which for reasons of plant health have been prescribed for all varieties of a particular species in the production area.71
