Art. 12d

1 Treffen Gesuchsteller und Organisation Vereinbarungen über Verpflichtungen, die Belange des öffentlichen Rechts betreffen, so gelten diese ausschliesslich als gemeinsame Anträge an die Behörde. Diese berücksichtigt das Ergebnis in ihrer Verfügung oder ihrem Entscheid. Sie verzichtet darauf, wenn es Mängel nach Artikel 49 des Bundesgesetzes vom 20. Dezember 196836 über das Verwaltungsverfahren aufweist.

2 Vereinbarungen zwischen Gesuchstellern und Organisationen über finanzielle oder andere Leistungen sind nicht zulässig, soweit diese bestimmt sind für:

a.
die Durchsetzung von Verpflichtungen des öffentlichen Rechts, insbesondere behördlicher Auflagen;
b.
Massnahmen, die das öffentliche Recht nicht vorsieht oder die in keinem Zusammenhang mit dem Vorhaben stehen;
c.
die Abgeltung eines Rechtsmittelverzichts oder eines anderen prozessualen Verhaltens.

3 Die Rechtsmittelbehörde tritt auf eine Beschwerde nicht ein, wenn diese rechtsmissbräuchlich ist oder die Organisation unzulässige Leistungen im Sinne von Absatz 2 gefordert hat.

Art. 12d

1 If an applicant and an organisation enter into an agreement on obligations that relate to public law matters, this agreement shall be deemed exclusively to be a joint application to the authority. The authority shall take account of the effect of the agreement in its ruling or decision, unless the agreement is defective in terms of Article 49 of the Federal Act of 20 December 196836 on Administrative Procedure.

2 Agreements between applicants and organisations on financial or other benefits are not permitted if they relate to:

a.
the enforcement of public law obligations, and in particular official requirements;
b.
measures not provided for under public law or that have no connection with the project;
c.
payment in return for a waiver of a right of recourse or for any other procedural concession.

3 The appeal authority shall dismiss an appeal if it is an abuse of legal process or the organisation has demanded unlawful payments in terms of paragraph 2.
