Art. 12

1 Gegen Verfügungen der kantonalen Behörden oder der Bundesbehörden steht das Beschwerderecht zu:

a.
den Gemeinden;
b.
den Organisationen, die sich dem Naturschutz, dem Heimatschutz, der Denkmalpflege oder verwandten Zielen widmen, unter folgenden Voraussetzungen:
1.
die Organisation ist gesamtschweizerisch tätig,
2.
sie verfolgt rein ideelle Zwecke; allfällige wirtschaftliche Tätigkeiten müssen der Erreichung der ideellen Zwecke dienen.

2 Das Beschwerderecht steht den Organisationen nur für Rügen in Rechtsbereichen zu, die seit mindestens zehn Jahren Gegenstand ihres statutarischen Zwecks bilden.

3 Der Bundesrat bezeichnet die zur Beschwerde berechtigten Organisationen.

4 Zuständig für die Beschwerdeerhebung ist das oberste Exekutivorgan der Organisation.

5 Die Organisationen können ihre rechtlich selbständigen kantonalen und überkantonalen Unterorganisationen für deren örtliches Tätigkeitsgebiet generell zur Erhebung von Einsprachen und im Einzelfall zur Erhebung von Beschwerden ermächtigen.

30 Fassung gemäss Ziff. II 1 des BG vom 20. Dez. 2006, in Kraft seit 1. Juli 2007 (AS 2007 2701; BBl 2005 5351 5391). Die Bestimmung über die wirtschaftliche Tätigkeit in Abs. 1 Bst. b Ziff. 2 tritt am 1. Juli 2010 in Kraft.

Art. 12

1 A right of appeal against rulings of the cantonal authorities or the federal authorities shall be accorded to:

a.
the communes;
b.
the organisations concerned with nature protection, cultural heritage protection, monument preservation or related objectives, subject to the following requirements:
1.
the organisation is active throughout Switzerland,
2.
it pursues solely non-profit-making objects; any commercial activities must serve the achievement of its non-profit-making objects.

2 The right of appeal is accorded to the organisations only in legal fields that have formed part of their objects for at least ten years.

3 The Federal Council shall designate the organisations entitled to appeal.

4 The supreme executive body of the organisation is responsible for filing the appeal.

5 The organisations may give general authorisation to their legally independent cantonal and supra-cantonal sub-organisations to raise general objections or to file appeals in specific cases that relate to their local area of activity.
