351.1 Federal Act of 20 March 1981 on International Mutual Assistance in Criminal Matters (Mutual Assistance Act, IMAC)
Art. 79a Entscheid des Bundesamtes
Das Bundesamt kann über die Zulässigkeit der Rechtshilfe entscheiden und die Ausführung einer kantonalen Behörde übertragen oder selber über die Ausführung entscheiden, wenn:
- a.
- das Ersuchen Erhebungen in mehreren Kantonen erfordert;
- b.
- die zuständige kantonale Behörde nicht in der Lage ist, innerhalb angemessener Frist einen Entscheid zu fällen; oder
- c.
- es sich um komplexe oder besonders bedeutende Fälle handelt.
Art. 79a Decision of the Federal Office
The Federal Office may decide whether mutual assistance is permitted and delegate its execution to a cantonal authority or itself decide on the execution if:
- a.
- the execution of the request necessitates investigations in more than one canton;
- b.
- the competent cantonal authority is unable to make a decision within the appropriate time; or
- c.
- the cases are complex or particularly important.
