1 Wird eine lebenslänglich verwahrte Person bedingt entlassen oder wird ihre Verwahrung aufgehoben und begeht diese Person erneut ein Verbrechen nach Artikel 64 Absatz 1bis, so haftet das zuständige Gemeinwesen für den daraus entstandenen Schaden.
2 Für den Rückgriff auf den Täter und die Verjährung des Anspruchs auf Schadenersatz oder Genugtuung gelten die Bestimmungen des Obligationenrechts503 über die unerlaubten Handlungen.
3 Für den Rückgriff auf die Mitglieder der anordnenden Behörde ist das kantonale Recht beziehungsweise das Verantwortlichkeitsgesetz vom 14. März 1958504 massgebend.
1 If a person subject to lifelong incarceration is released on parole or discharged from incarceration and commits a felony mentioned in Article 64 paragraph 1bis, the responsible body politic shall be liable for the resultant injury and loss.
2 In relation to rights of recourse against the offender and the time limits for filing claims for damages or satisfaction, the provisions of the CO503 on unlawful acts apply.
3 In relation to rights of recourse against the members of the authority issuing the order, cantonal law or the Government Liability Act of 14 March 1958504 applies.
