1 Ist durch das Zurückbehalten der Gegenstände ein Schaden zu befürchten, so kann das BAZG das Zurückbehalten davon abhängig machen, dass die Antragstellerin ihm eine Haftungserklärung abgibt. An deren Stelle kann das BAZG von der Antragstellerin in begründeten Fällen eine angemessene Sicherheitsleistung verlangen.
2 Die Antragstellerin muss den Schaden, der durch das Zurückbehalten der Gegenstände und die Entnahme von Proben oder Mustern entstanden ist, ersetzen, wenn vorsorgliche Massnahmen nicht angeordnet werden oder sich als unbegründet erweisen.

1 Where it is anticipated that withholding the items may lead to a loss being incurred, the FOCBS may make withholding of the items dependent on the applicant providing them with an accountability statement. As an alternative to this statement and where justified by circumstances, the FOCBS may request the applicant to provide appropriate security.
2 The applicant is liable for any losses incurred from withholding the items and from collecting the samples if preliminary measures are not ordered or prove to be unfounded.
