1 Der Schuldner haftet im Allgemeinen für jedes Verschulden.
2 Das Mass der Haftung richtet sich nach der besonderen Natur des Geschäftes und wird insbesondere milder beurteilt, wenn das Geschäft für den Schuldner keinerlei Vorteil bezweckt.
3 Im übrigen finden die Bestimmungen über das Mass der Haftung bei unerlaubten Handlungen auf das vertragswidrige Verhalten entsprechende Anwendung.
1 The obligor is generally liable for any fault attributable to him.
2 The scope of such liability is determined by the particular nature of the transaction and in particular is judged more leniently where the obligor does not stand to gain from the transaction.
3 In other respects, the provisions governing liability in tort apply mutatis mutandis to a breach of contract.
