1 Auf Auszahlung von Zinsen und Gewinn hat der Kommanditär nur Anspruch, wenn und soweit die Kommanditsumme durch die Auszahlung nicht vermindert wird.
2 Der Kommanditär ist verpflichtet, unrechtmässig bezogene Zinsen und Gewinne zurückzubezahlen. Artikel 64 findet Anwendung.291
