1 Mit dem Tod des Arbeitnehmers erlischt das Arbeitsverhältnis.
2 Der Arbeitgeber hat jedoch den Lohn für einen weiteren Monat und nach fünfjähriger Dienstdauer für zwei weitere Monate, gerechnet vom Todestag an, zu entrichten, sofern der Arbeitnehmer den Ehegatten, die eingetragene Partnerin, den eingetragenen Partner oder minderjährige Kinder oder bei Fehlen dieser Erben andere Personen hinterlässt, denen gegenüber er eine Unterstützungspflicht erfüllt hat.206
