1 Sind dem Borger statt der verabredeten Geldsumme Wertpapiere oder Waren gegeben worden, so gilt als Darlehenssumme der Kurswert oder der Marktpreis, den diese Papiere oder Waren zurzeit und am Orte der Hingabe hatten.
2 Eine entgegenstehende Übereinkunft ist nichtig.
1 Where the borrower receives securities or goods rather than the agreed sum of money, the amount of the fixed-term loan is deemed to be the current or market price of the securities or goods concerned at the time and place of delivery.
2 Any agreement to the contrary is void.
