1 Ist ein Vertragschliessender von dem anderen oder von einem Dritten widerrechtlich durch Erregung gegründeter Furcht zur Eingehung eines Vertrages bestimmt worden, so ist der Vertrag für den Bedrohten unverbindlich.
2 Ist die Drohung von einem Dritten ausgegangen, so hat, wo es der Billigkeit entspricht, der Bedrohte, der den Vertrag nicht halten will, dem anderen, wenn dieser die Drohung weder gekannt hat noch hätte kennen sollen, Entschädigung zu leisten.
1 Where a party has entered into a contract under duress from the other party or a third party, he is not bound by that contract.
2 Where the duress originates from a third party and the other party neither knew nor should have known of it, a party under duress who wishes to be released from the contract must pay compensation to the other party where equity so requires.
