1 Dient die gemietete Sache als Wohnung der Familie, kann ein Ehegatte den Mietvertrag nur mit der ausdrücklichen Zustimmung des anderen kündigen.
2 Kann der Ehegatte diese Zustimmung nicht einholen oder wird sie ihm ohne triftigen Grund verweigert, so kann er den Richter anrufen.
3 Die gleiche Regelung gilt bei eingetragenen Partnerschaften sinngemäss.100
