1 Die Nebenrechte werden vom Schuldnerwechsel, soweit sie nicht mit der Person des bisherigen Schuldners untrennbar verknüpft sind, nicht berührt.
2 Von Dritten bestellte Pfänder sowie die Bürgen haften jedoch dem Gläubiger nur dann weiter, wenn der Verpfänder oder der Bürge der Schuldübernahme zugestimmt hat.
