220 Federal Act of 30 March 1911 on the Amendment of the Swiss Civil Code (Part Five: The Code of Obligations)
Art. 110 A. Eintritt eines Dritten
Soweit ein Dritter den Gläubiger befriedigt, gehen dessen Rechte von Gesetzes wegen auf ihn über:
- 1.
- wenn er eine für eine fremde Schuld verpfändete Sache einlöst, an der ihm das Eigentum oder ein beschränktes dingliches Recht zusteht;
- 2.
- wenn der Schuldner dem Gläubiger anzeigt, dass der Zahlende an die Stelle des Gläubigers treten soll.
Art. 110 A. Subrogation
A third party who satisfies the creditor is by operation of law subrogated to his rights:
- 1.
- if he redeems an object given in pledge for the debt of another and he owns said object or has a limited right in rem in it;
- 2.
- if the debtor notifies the creditor that the third party who is paying is to take the creditor’s place.
