211.222.32 Federal Act of 21 December 2007 on International Child Abduction and the Hague Conventions on the Protection of Children and Adults
Art. 5 Rückführung und Kindeswohl
Die Rückführung bringt das Kind insbesondere dann in eine unzumutbare Lage nach Artikel 13 Absatz 1 Buchstabe b HKÜ, wenn:
- a.
- die Unterbringung bei dem das Gesuch stellenden Elternteil offensichtlich nicht dem Wohl des Kindes entspricht;
- b.
- der entführende Elternteil unter Würdigung der gesamten Umstände nicht in der Lage ist oder es ihm offensichtlich nicht zugemutet werden kann, das Kind im Staat zu betreuen, in dem es unmittelbar vor der Entführung seinen gewöhnlichen Aufenthalt hatte; und
- c.
- die Unterbringung bei Drittpersonen offensichtlich nicht dem Wohl des Kindes entspricht.
Art. 5 Return and best interests of the child
Under Article 13 paragraph 1 letter b of the 1980 Hague Convention, the return of a child places him or her in an intolerable situation where:
- a.
- placement with the parent who filed the application is manifestly not in the child's best interests;
- b.
- the abducting parent is not, given all the circumstances, in a position to take care of the child in the State where the child was habitually resident immediately before the abduction or this cannot reasonably be required from this parent; and
- c.
- placement in foster care is manifestly not in the child's best interests.
