II. Duty to obtain a licence

¹ Professional marriage and partnership brokerage activities involving foreign nationals require a licence issued by the authority designated by cantonal law and are regulated by that authority.

² The Federal Council issues the implementing provisions and determines in particular:

a.: licence requirements and durations;
b.: the penalties imposed on the agent in the event of infringements;
c.: the obligation of the agent to furnish security for the costs of repatriating persons introduced under the contract.

¹ Le mandat visant à la conclusion d’un mariage ou à l’établissement d’un partenariat est un contrat par lequel le mandataire s’oblige envers le mandant, moyennant rémunération, à lui présenter des personnes en vue de la conclusion d’un mariage ou de l’établissement d’un partenariat stable.

² Les règles du mandat proprement dit sont applicables à titre supplétif à ce mandat.
