1 Se la cosa venduta deve essere spedita in luogo diverso da quello ove l’obbligazione deve eseguirsi, le spese di trasporto sono a carico del compratore, salvo patto od uso contrario.
2 Si presume che le spese di trasporto siano state assunte dal venditore, se fu pattuita la consegna franca.
3 Se fu pattuita la consegna franca di porto e di dogana si ritengono a carico del venditore anche i dazi d’uscita, di transito e d’entrata esatti durante il trasporto, ma non le tasse di consumo che sono esatte al ricevimento della cosa.
1 Unless otherwise provided by agreement or custom, if the object sold must be transported to a place other than the place of performance, the buyer bears the costs of such transport.
2 The seller is presumed to have borne the transport costs where free delivery has been agreed.
3 Where delivery free of shipping costs and duties has been agreed, the seller is deemed to have assumed the export, transit and import duties payable during transport but not the consumer tax levied on receipt of the object.
