232.14 Federal Act of 25 June 1954 on Patents for Inventions (Patents Act, PatA)
Art. 140k
1 Le certificat est nul si:
- a.272
- il a été délivré en violation des art. 140b, 140c, al. 2, 146, al. 1, ou 147, al. 1;
- b.
- le brevet s’éteint avant l’expiration de sa durée maximale (art. 15);
- c.
- la nullité du brevet est constatée;
- d.
- le brevet est limité de telle sorte que ses revendications ne couvrent plus le produit pour lequel le certificat a été délivré;
- e.
- après l’extinction du brevet, il existe des motifs qui auraient justifié la constatation de la nullité du brevet au sens de la let. c ou une limitation au sens de la let. d.
2 Toute personne peut intenter une action en constatation en nullité du certificat auprès de l’autorité compétente pour la constatation de la nullité du brevet.
Art. 140n
1 The IPI shall extend the term of protection (Art. 140e) of certificates issued by six months if the authorisation (Art. 9 TPA275) of a medicinal product containing the product:
- a.
- contains confirmation that the information on the medicinal product reflects the results of all studies performed in accordance with the paediatric test concept (Art. 11 para. 2 let. a no 6 TPA) considered in the authorisation process; and
- b.
- was applied for no later than six months after the application for initial authorisation in the European Economic Area of a medicinal product containing the product in which the corresponding medicinal product information reflects the results of all studies performed in accordance with the paediatric test concept considered for the authorisation.
2 A certificate’s term of protection may only be extended once.
