Art. 420 II. Liability of the agent in general

1 The agent is liable for negligence.

2 However, where the agent acted in order to avert imminent damage to the principal, his liability is judged more leniently.

3 Where agency activities are carried out against the express or otherwise recognisable will of the principal and the prohibition was neither immoral nor illegal, the agent is also liable for chance occurrences unless he can prove that they would have occurred even without his involvement.

Art. 420 II. Responsabilità del gestore in genere

1 Il gestore è responsabile d’ogni negligenza.

2 Però la sua responsabilità sarà meno rigorosamente apprezzata, ove abbia agito allo scopo di evitare al padrone un danno imminente.

3 Quando egli abbia assunto l’affare contro la volontà espressa od altrimenti conosciuta del padrone ed il divieto di questo ultimo non fosse né immorale né illecito, è responsabile anche dei casi fortuiti, sempreché non provi che sarebbero accaduti anche ove egli non vi fosse immischiato.
